ПРАВО ДЕТЕТА НА ИДЕНТИТЕТ У КОНТЕКСТУ ПРАВИЛА О АНОНИМНОСТИ ДОНОРА РЕПРОДУКТИВНИХ ЋЕЛИЈА

САЖЕТАК /

Значај права детета на идентитет, које је изричито признато чланом 8 Конвенције Уједињених нација о правима детета, резултирао је напуштањем традиционалног принципа анонимности донора репродуктивног материјала у великом броју европских држава. Међутим, одређена национална законодавства још увек се приклањају том концепту забране откривања идентитета донора, док поједина предвиђају мешовити модел с циљем уравнотежења супротстављених интереса. Дебата је поларизована између права на приватност донора и родитеља и права детета да зна своје биолошко порекло. У раду је размотрен утицај правила о анонимности на могућност остваривања права детета на идентитет. Анализа различитих решења држава европског правног простора и ставова органа надлежних за контролу примене најзначајнијих међународних уговора довела је до издвајања одговарајућих смерница за одмеравање интереса у конфликту. Иако је идеално решење тог питања тешко замисливо, задовољавајући би могао бити режим који пружа гаранције интересима свих лица, с фокусом на заштиту права детета као најугроженије стране.
