Једно од актуелних, а важних питања кривичног процесног права у савременим условима је питање прихватања доказа прикупљених у иностранству и могућности њихове употребе у кривичном поступку. Као традиционални механизам за прикупљање доказа у другој држави користе се правила о пружању узајамнe правнe помоћи у кривичним стварима. Но, у оквиру Европске уније, заједнице чија чланица тежи наша држава да постане, присутна је тенденција да се на прикупљање доказа у кривичним стварима с прекограничним елементима прошири дејство принципа узајамног признавања одлука и успостави режим „слободног кретања“, односно „увоза/извоза“ доказа између држава чланица. Наиме, анализом стратешких докумената и усвојених извора права почевши од краја XX века може се уочити јасно опредељење ка унапређењу овог аспекта међународне правне помоћу у кривичним стварима, што је резултирало доношењем Директиве о европском налогу за истрагу 2014. године. Интенција аутора овог рада је да критички сагледа правила која предвиђају „преношење/преузимање“ доказа прикупљених у једној држави чланици у државу чланицу која је тражила предузимање доказних радњи за потребе кривичног поступка пред домаћим органом поступка, с нагласком на последице која ова правила могу имати на уобличавање правних норми у домаћем кривичном процесном праву.
