ЕМПИРИЈСКО ИСТРАЖИВАЊЕ ПРАВА: РЕВОЛУЦИЈА ИЛИ НЕМОГУЋА МИСИЈА?

Емпиријско истраживање права настоји да одговори на проблем одво­јености правне науке и права од друштвене стварности. Оно означава промену у приступу истраживању права. Какав је квалитет те промене? Због тог питања било је неопходно остварити што потпунији увид у емпиријско истраживање права. У раду су представљена основна обележја емпиријског истраживања права и историјски развој ове врсте истраживања у свету, као и тренутно стање у Србији. Ради превазилажења једнодимензионалног поимања овог научног приступа као искључиво квантитативног, размотрена је разлика између квантитивног и квалитативног приступа у емпиријском истраживању. Потпунији и критички приказ емпиријског истраживања права захтевао је да се укаже на ограничења и изазове у његовој примени. У закључку аутор објашњава да емпиријско истраживање није коренита промена у начину истраживања права, али јесте промена чији ће успех зависити од методолошких способности истраживача.
